Privacy Statement Swim4Brains

Privacy Statement

This privacy statement is issued by the Stichting Swim4Brains, registered under the laws of the Netherlands, with its registered seat in Amsterdam and offices at (1018 MP) Amsterdam, Oosterburgervoorstraat 63A, registered in the Trade Register of the Chamber of Commerce under number 97928429 (hereinafter: โ€˜Swim4Brainsโ€™ or โ€˜weโ€™).

Are you a donor, sponsor, participant, or campaign starter for the Swim4Brains campaign? In this privacy statement, we explain how we handle your (personal) data.

Swim4Brains is responsible for processing your data. Swim4Brains complies with the requirements of the GDPR in all cases. Swim4Brains also adheres to the codes of conduct of Goede Doelen Nederland, the industry association for charity organizations.

Personal Data

Via this platform, we collect the following personal data for the following purposes:

  • organizing Swim4Brains and enabling your participation;
    Do you sign up to participate in Swim4Brains? Swim4Brains then registers your details (name, email address, address, place of residence, phone number, and payment details for the registration fee) so that you can participate in Swim4Brains and so we can inform you about everything you need to know about your participation. You will receive information about your participation and the status of your collected donations via email and SMS. The legal basis for this processing is the execution of the agreement to participate in Swim4Brains.

  • creating and managing an active campaign (specifically the sponsor campaigns related to Swim4Brains) and processing, initiating, and executing an online donation or sponsorship gift;
    Are you starting a campaign or donating/sponsoring a campaign? Swim4Brains then records your name, phone number, email address, address details, and bank details, data relating to transactions (amount, time of transaction, bank account number, and bank account holder name), donations, participation details, or data that is relevant if you contact Swim4Brains or contribute financially to the objectives of Swim4Brains as a sponsor, donor, campaign starter, and/or participant in campaigns or events. The legal basis for this processing is the execution of the agreement to participate in Swim4Brains or the agreement to make a donation.

If you make a donation or sponsorship gift to a campaign, you can choose to donate anonymously to the campaign starter. In this case, only the sponsorship amount and not your name will be shared with the campaign starter. Swim4Brains will still process your transaction details so that we can carry out the payment. This concerns the amount you donate, the moment the transaction takes place, your bank account number, and the name of the bank account holder. The legal basis for this is again the execution of the agreement.

If you do not donate anonymously, the campaign starter will have access to the name you chose as a donor and the (sponsorship) amount (including date and time) and any personal message. The legal basis for this processing is consent.

  • displaying photos, personal story, or motivation on your campaign page
    If you choose to share photos, a personal story, or your motivation on your campaign page, we also process the data you upload through our platform. Uploading photos or your motivation to your campaign page is optional. We point out that the data you post on your campaign page is publicly accessible. The legal basis for this processing is consent.
    Please note: Are you participating in Swim4Brains because you know someone with a brain disease, for example, a partner, family member, or friend? And do you want to mention that in your motivation, for example, with a story about or a photo of that person? We then ask you to obtain clear prior consent from that person. By sharing such data with us through our platform, you confirm that you have this consent.

  • informing about activities
    Swim4Brains keeps sponsors, donors, participants, campaign starters, and other interested parties informed. Swim4Brains may also ask you for (financial) support in emails and by post. You will have the opportunity to unsubscribe when registering and in every newsletter. You can also opt-out of receiving post from us. The legal basis for this processing is the legitimate marketing interest of Swim4Brains.

  • optimizing the website and email
    To optimize the content of Swim4Brains emails, open and click rates of emails can be viewed and recorded on an individual level. Swim4Brains does this to keep communications as interesting as possible for the recipients. Cookies are also placed on Swim4Brains websites to optimize the website and to offer targeted content. The legal basis for this processing is the legitimate marketing interest of Swim4Brains (for functional cookies and cookies with a minor impact on your privacy) or consent (for other cookies). For more information, please see the Cookie Statement.

  • improving services
    In certain cases, Swim4Brains uses the email address of sponsors, donors, participants, campaign starters, and other interested parties for research to improve its services. The legal basis for this processing is the legitimate interest of Swim4Brains in maintaining the quality of its services.

  • Social media advertising options
    Swim4Brains uses the Facebook pixel to measure the effectiveness of advertisements. Through the privacy settings of the social media channel, such as Facebook, you can opt-out of advertisements or change your preferences. The legal basis for this processing is consent.

Telemarketing

Swim4Brains can only inform you by telephone about its activities and projects or ask for support if you have consented to this. We may also contact existing donors, collectors, and former donors (up to 3 years back) by telephone without consent. If you indicate that you no longer wish to receive this, we will of course respect this. Swim4Brains may still inform you by telephone about necessary or service-related matters. If you do not wish to be called by us outside of necessary and service-related matters, you can indicate this during any telephone call or send an email to info@swim4brains.nl.

Providing data to third parties

Swim4Brains may use the services of third parties to process your data in accordance with this privacy statement. These third parties act as processors for Swim4Brains and we ensure that these parties provide sufficient guarantees regarding technical and organizational security measures. Third parties acting as processors for Swim4Brains have entered into a data processing agreement with Swim4Brains, which stipulates, among other things, that they will only process this personal data on behalf of Swim4Brains.

A secure server is used that is only accessible to authorized persons. All data of online visitors, donors/sponsors, and campaign starters left within the campaign platform are sent encrypted and stored in secure systems.

Retention period

Campaign starters can stop a campaign at any time by ending the set-up campaign. Swim4Brains does not store personal data longer than necessary for the purposes for which they were obtained.

Payment

For executing and processing donations, we collaborate with Mollie B.V. This party processes the payment between the campaign platform and your bank and thereby gets access to payment details.
